Process of imposing standards

 

Standards will gradually replace the current system of Welsh language schemes, introduced by Welsh Language Act 1993.

There is a statutory process to follow to impose standards on the Welsh Language on organizations.

The Welsh Language (Wales) Measure 2011 refers to organizations who are liable to be required to comply with standards. An organization is liable to be required to comply with standards if it is specified (or comes within a category specified) in Schedules 5 and 6, or Schedules 7 and 8. The fact that an organization is liable to be required to comply with standards does not mean that it is required to do so. Standards will need to be made specifically applicable to an organization before they can become required to comply with them. 

Standards Investigations
The first step to making standards specifically applicable to an organization is to carry out a standards investigation. The Commissioner will carry out a standards investigation to decide whether the organization should have to comply with standards, and if so, which standards should be specifically applicable to them. Standards reports
After carrying out a standards investigation the Commissioner will publish a standards report which will set out the conclusions of the investigation, and the Commissioner’s reasons for reaching those conclusions. Regulations
After giving due regard to the Commissioner’s standards report, Welsh Ministers will be expected to produce draft regulations and associated documentation in relation to the relevant organization. There will be a debate and vote on approval of the draft regulations in the National Assembly’s plenary session. A vote on approval of the regulations will make the standards specifically applicable to the organization, and enable the Commissioner to give them a compliance notice.
