Investigations

 

Section 71 of the Welsh Language (Wales) Measure 2011 (the Measure) gives the Welsh Language Commissioner the power to investigate whether an organization has failed to comply with a requirement, namely one or more of the following:

  • a duty to comply with a standard specified by Welsh Ministers*
  • a requirement included in a decision notice under section 79 of the Measure - the requirement to prepare an action plan, or to take action
  • an action plan
  • a requirement included in a decision notice under section 82 of the Measure - publicising a failure to comply.

* If the relevant requirement is a duty to comply with a standard, the Commissioner may undertake an investigation only if she suspects that an organization has failed to comply with the standard.
